Our Terms & Conditions
The following conditions govern all hires by KL Spectator Seating (KLSS) and supersede any previous communications or any other terms and conditions purporting to relate to the hire unless expressly agreed by KLSS in writing.
1) All quotations made are subject to the availability of Grandstands when the hirer confirms in writing.
2) All quotations are made subject to the following understanding :
a) Hire charges do not include attendance by KLSS employees for any other purpose other than setting up or dismantling.
b) Period of hire means the period for which the equipment is required to be ready for use.
c) The size, surface and access to the site are suitable for the setting up of the equipment.
d) Heavy delivery vehicles are able to operate on site.
e) The hirer has informed KLLSS of any drains, pipes, cables etc. which might be affected and hirer will be responsible for the repair or making good of any damage to the site generally.
3) The hirer shall be responsible for the safe custody of equipment hired while on site and will make good to KLSS any loss or damage caused to such equipment (fair wear and tear excepted) unless such loss or damage was caused by faulty materials or equipment.
a) should the hirer request the Grandstand (s) be placed on a surface other than firm road , it will be the hirer responsibility for the towing on or off site if required . All cost to be borne by the hirer.
4) Insurance :-
KLSS may insure all equipment upon request on behalf of the hirer for 5% of the total job cost (ex VAT). The hirer shall be liable for any uninsured losses which shall include :
a) £250 excess
b) Any liability to any third party, including KLSS
The hirer is advised to take out his own insurance in respect of such matters including in particular a public liability insurance.
5) Payment :-
a) KLSS reserve the right to charge a deposit which shall be paid by the hirer when confirming the booking.
b) KLSS reserve the right to receive full payment from the hirer on the date on which the equipment is supplied.
c) All invoices are due for payment within 30 days of invoice date.
d) The hirer shall also be liable for any additional KLSS costs or charges if extra work or equipment outside the terms of the quotation are required or used for any period outside the period of hire.
6) Cancellation :-
In the event that the hirer cancels the contract the hirer shall remain responsible for the following charges :
a) If the cancellation is notified more than one month before commencement of hire, the deposit shall be forfeit. If no deposit has been paid then out of pocket expenses incurred by KLSS shall be reimbursed.
b) If cancellation is notified 7 to 30 days before the date of commencement of hire then the hirer shall be liable for one half of quoted cost.
c) If cancellation is notified within 7 days of the date of commencement of hire, the hirer shall be liable for the whole quoted cost.
7) Delay :-
KLSS shall not be liable for delay to or failure to complete any contract as a result of :
a) The site being unsuitable or access being unavailable on the date or time stated for delivery and erection.
b) Adverse wind or weather conditions.
c) Loss or damage to equipment by fire or flood
d) Any industrial dispute lock out or strike.
e) Any cause outside the control of KLSS.
f) Grass sites which have not been cut.
g) Force Majeure.
8) The hirer shall ensure that the site is available at the agreed time for delivery and set up of equipment and shall provide a plan showing the position in which the Grandstand(s) is to be sited, or have a representative on site for that purpose. In the absence of such a plan or representative KLSS may site the Grandstand(s) in such a manner as they consider appropriate.
9) If unforeseen circumstances arise which means that the Grandstand(s) booked are not available, KLSS reserve the right to substitute alternative sizes or types of Grandstand(s) to meet as near as possible the requirement of the hirer in which event no claim shall lie against KLSS.
10) All equipment shall at all times remain the property of KLSS and the hirer shall not be entitled to sub-hire or part with possession of the equipment ( Grandstand(s) ) and nor shall the hirer allow any lien or encumbrance to be created over the equipment.
11) Any self-adhesive labels placed on equipment (e.g.; Grandstand seat numbers) must be PVC material, not paper. With regard to Grandstands, labels must be placed on the front of the seats and removed by the hirer immediately after the event. The cost of any damage or cleaning will be the responsibility of the hirer and will be charged, shown as a separate item.
